When the System Gets It Wrong: Securing 100% Disability Through Strategy and Persistence

For many veterans, the path to receiving disability benefits is not straightforward. Even when conditions are severe and life-altering, claims can be denied due to technicalities, incomplete evaluations, or the wrong legal theory being applied.

Our client initially sought service connection for a psychological condition based on stressful incidents during military service. However, the Department of Veterans Affairs denied the claim, stating that the incidents occurred during a period that did not qualify for service connection.

Through a detailed review of the file, the legal team identified that the client’s chronic pain had led to the development of a psychological condition. A strong medical nexus opinion was obtained to establish this connection.

Even then, the process was not simple. The VA repeatedly failed to properly consider the evidence, requiring multiple appeals and continued advocacy over several years.

A Favorable Outcome: 100% Permanent and Total

In March 2026, the VA issued a fully favorable decision.

The client was granted 100% Permanent and Total disability, with benefits backdated to January 2023, resulting in a total award of approximately $58,000, along with ongoing lifetime benefits.

The Impact: More Than Financial Support

For the client, this outcome meant more than financial relief.

It meant stability.
It meant access to care.
And most importantly, it meant peace of mind.

As the client shared, this was the first time he felt able to truly breathe since leaving the military.
